The devastating explosion at The Clyde Apartments in Oak Cliff has left Dallas families grieving, residents displaced, and an entire community searching for answers. So far, reports say that killed three people were killed and several others were injured after a gas leak caused the building to explode.
Kherkher Garcia has filed one of the first lawsuits arising from the tragedy and is working to help victims and families understand their legal rights.
The explosion occurred at Patton Avenue and East 9th Street after firefighters received a call about a possible gas leak at the apartment complex. According to officials, emergency crews were on scene and were preparing to evacuate residents when the building exploded.
The force of the blast destroyed the building, leaving not much more than a pile of charred debris. The explosion triggered a massive emergency response involving more than 100 firefighters. As the fire subsided, urban search and rescue teams, drones, and cadaver dogs joined the rescue efforts.
Federal investigators with the National Transportation Safety Board (NTSB) are now leading the investigation because the incident involves a natural gas pipeline. The gas lines in the area are owned and operated by Atmos Energy Corp. The cause of the explosion has not yet been determined.
Just days after the blast, Kherkher Garcia has filed a lawsuit in Dallas County against Atmos Energy on behalf of apartment resident Onecimo Ponce Mendoza. According to the lawsuit, Mr. Ponce Mendoza was asleep inside the apartment complex when the explosion occurred. He suffered serious burns, inhalation injuries, and other injuries while attempting to escape the building.
The lawsuit alleges that Atmos Energy failed to do the following:
Kherkher Garcia founding partner Jesus Garcia, Jr. stated,
“Atmos Energy is the source of far too many deaths and severe injuries year after year. At Clyde Apartments, people lost their lives and so many others are hurt; their lives are forever altered. We are prepared to aggressively fight for Mr. Ponce Mendoza and all victims to ensure that Atmos Energy is held accountable while recovering maximum damages.”
Atmos Energy has stated that a construction company damaged a natural gas pipeline near the property shortly before the explosion. The company says it is cooperating fully with investigators.
