Parents trust daycare providers with what matters most – the safety and well-being of their children. When that trust is broken, the harm goes far beyond physical injuries. A recently filed daycare injury lawsuit in San Antonio highlights serious allegations of toddler abuse inside a daycare classroom and raises critical questions about supervision, safety, and accountability.
Kherkher Garcia, alongside co-counsel, has filed a lawsuit on behalf of parents whose 3-year-old child was injured while under the care of a daycare provider. The case underscores why oversight, training, and enforcement of safety standards are so vital in childcare settings and why families deserve answers when something goes wrong.
According to reports, the alleged incident occurred on January 6 inside a classroom at KIDUS Daycare, located off Bulverde Road in San Antonio. The child, a 3-year-old boy, was reportedly playing near a rolling classroom caddy when one of the caddies tipped over.
Security video reviewed after the incident allegedly shows daycare provider Veronica Jimenez reacting angrily, grabbing the child by the arm, and causing him to strike his head and fall. She can then be seen grabbing the child by the arm and walking out of the room. The footage was later obtained and reviewed by law enforcement.
Deputies with the Bexar County Sheriff’s Office arrested Jimenez, who has since been charged with felony injury to a child – reckless bodily injury. She was released on a $30,000 bond and is expected back in court on April 7. Jimenez has reportedly been terminated from her position at the daycare.
On February 5, Kherkher Garcia, LLP and Ali Law Group, PLLC filed a civil lawsuit on behalf of the child’s parents, Ali and Hoda Ibrahim. The lawsuit names multiple defendants, including:
The suit alleges that the daycare and its parent company failed in their duty to protect children in their care. In addition to other damages and court costs, the plaintiffs are seeking between $1 and $5 million related to gross negligence claims. Claims in the lawsuit include:
“At first the daycare said, you know, your son, he was running, it was nap time, he wouldn’t listen, and he was just running around like a crazy kid and he fell and he hit his head,” Omar Chawdhary, partner with Kherkher Garcia, LLP.
According to the lawsuit, the video evidence shows Jimenez “reacting immediately, visibly angry, and charging toward the young boy.” These allegations, if proven, raise serious concerns about daycare oversight and institutional responsibility.
“Mostly it’s gonna be emotional and mental. He is still talking about it. He’s out of the daycare. He’s scared of daycare, he’s scared teachers, but it’s a long-lasting emotional trauma,” Chawdhary said.
This case is about more than a single incident. It highlights broader issues that affect families across Texas:
Civil lawsuits like this play a critical role in uncovering what happened, holding responsible parties accountable, and pushing childcare providers to improve safety standards. For many families, legal action is also the only way to obtain transparency and prevent similar harm to other children.
When a child is harmed at daycare, parents often feel overwhelmed, angry, and unsure where to turn. Texas law recognizes that childcare providers owe children a heightened duty of care. Depending on the circumstances, parents may have the right to pursue claims related to:
Even if a caregiver faces criminal charges, a separate civil lawsuit may still be necessary to fully address the harm and hold institutions accountable.
Parents should consider speaking with an attorney as soon as possible if:
